What to expect when Driving Under the Influence in Scottsdale, Arizona:

The National Highway Traffic Safety Administration developed a series of preliminary roadside tests that an officer administers to potential offenders in order to detect DUI drivers.  When suspect of drunk driving, a Scottsdale police officer (trained and accredited to administer these tests) will most likely give you DUI Field Sobriety Tests to determine if you are driving impaired.  The police must have a driver’s consent in order to administer these tests, as they are not mandatory in Arizona. Three “official” Standard Field Sobriety Tests will most likely be conducted:

  • The Horizontal Gaze Nystagmus
  • The Walk-and-Turn
  • The One-Leg Stand

Scottsdale, Arizona DUI attorney adIf you are subject to other Field Sobriety Tests in Scottsdale, My AZ Lawyer criminal defense attorney can move to have those results suppressed, so they may not be admitted as evidence against you.

In Scottsdale, a driver stopped on a suspected DUI has the right to refuse the Field Sobriety Tests.  Are there consequences to not cooperating and complying to an officer’s request to do these tests?  If you do refuse the tests, and the police feel they have “probable cause” to make an arrest, they still may proceed.  A “suspicion of DUI” is enough for a police to proceed with an arrest, but you do have a right to avoid self-incrimination and politely refuse to participate in any of the Field Sobriety Tests.

Because of strict guidelines regarding the administrating of tests and other factors that can come into play affecting the results of the Field Sobriety Tests, (clothing, traffic conditions, lighting, weather, age, weight, physical handicaps) results may prove invalid.
